REGISTRATION IN PORTUGAL OF MARRIAGES CELEBRATED ABROAD

General Information

Marriages celebrated abroad between Portuguese citizens or between a Portuguese and a foreign national, must be registered in Portugal with the Civil Registry Office (Conservatória do Registo Civil) where the spouse(s) is (are) registered.

The registration is done through the nearest Portuguese Consulate. Once the process is completed by the Consulate a certification of registration is sent to the applicant.

Documents to be Submitted by Portuguese Spouses

  1. Portuguese identification document (BI or CC)
  2. Marriage certificate (corresponding to the type of ceremony performed, i.e., civil or religious), legalized by apostille by the Government of the country where marriage was performed. The marriage certificate presented should be the long form.
  3. A statement by the bride about the names she will be using after the marriage.
  4. Filled out Declaration.

Documents to be Submitted by a Spouse who is a Citizen of Another Country:

  • Birth certificate of the foreign spouse legalized by Apostille in the country where the birth occurred, must accompany the above documents.

Note: Only original or certified copies of the documents must be submitted.

          Documents cannot be returned to applicant.

  • If the official documents are American an apostille is not necessary; the original or certified copies of the certificates suffice.

REQUIREMENTS FOR AMERICAN CITIZENS TO MARRY IN PORTUGAL

General Information

Under Portuguese law, in a ceremony conducted by a Portuguese Civil Registrar or religious authority.

General Requirements:

  1. The parties must apply for a marriage license by submitting the documents listed below to the Civil Registry Office in the area where the marriage will take place.
  1. The parties must decide at the time of application to the Registrar under which terms they intend to marry, as required by Portuguese law, whether the parties intend to sign a pre-nuptial agreement or whether they will marry under the following terms:
  • With full communion of property
  • With communion of property acquired after marriage
  • With full separation of property

This preliminary process may take from 2 to 3 months and requires the presence in Portugal of at least one of the parties.

Documents to be submitted:

  • Certified copy of the birth certificates of each of the parties, certified by an Apostille issued by the Office of the Secretary of State of the state where the person was born.

An affidavit, issued by a competent American authority (religious or judicial) stating that the parties are free to marry, and certified by Apostille.

The above documents must be accompanied by a Portuguese translation.
